Terms of Service & Legal Disclaimers

1. Acceptance of terms
By accessing or using the website, API, or dashboard provided by Fraudalysis ("Fraudalysis", "we", "us", "our") at https://fraudalysis.com (the "Platform" or "Services"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Platform.
2. Platform licence and SaaS usage
Subject to compliance with these terms (and payment of any applicable subscription fees outlined in your service agreement), Fraudalysis grants you a non-exclusive, non-transferable, revocable licence to access and use our blockchain monitoring dashboard and API for your internal compliance, security, and research operations.
You agree not to:
- Reverse-engineer, decompile, or disassemble our proprietary machine-learning models, scoring algorithms, or backend systems;
- Use automated web-scraping or data-mining tools to extract our risk scores and intelligence database for resale or external redistribution without prior written consent;
- Bypass or attempt to bypass any API rate limits or security measures.
3. Web3 analytics & risk scoring disclaimer (critical disclosure)
Fraudalysis provides automated, machine-learning-driven risk scores, smart contract analysis, and threat alerts (the "Analytics").
A. Information, not advice
- No investment or financial advice: the Analytics, alerts, and risk scores are provided for general informational, educational, and risk-management purposes only. Nothing on the Platform constitutes investment, financial, tax, or trading advice. You should not buy, sell, or hold any crypto asset, or make any security decision, based solely on our risk scores.
- No legal advice: the Analytics do not constitute legal advice or formal compliance opinions. You are solely responsible for conducting your own due diligence and consulting qualified professionals regarding anti-money laundering (AML), counter-terrorist financing (CTF), and regional regulatory compliance.
B. Machine learning & predictive nature
- Statistical models: threat alerts and risk scores are derived from statistical and behavioural machine-learning models that calculate the probability of fraudulent behaviour based on historical blockchain patterns.
- No guarantees / "as is" basis: risk scoring does not guarantee the safety or malicious nature of any specific address or token. A low risk score does not mean a wallet is safe; a high risk score is a detected threat indicator, not a definitive legal finding of criminal activity. All Analytics are provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
4. Limitation of liability
To the maximum extent permitted by applicable law, Fraudalysis and its officers, directors, employees, and partners shall not be held liable for:
- Any direct, indirect, incidental, special, or consequential damages resulting from your use or inability to use the Platform;
- Any loss of funds, crypto assets, smart contract reserves, liquidity, or capital resulting from exploits, hacks, rug pulls, or scams — regardless of whether our monitoring flagged or failed to flag the corresponding threat;
- Any business disruption, loss of profits, reputational harm, or regulatory fines incurred in connection with our analytics or risk alerts.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded.
5. Third-party protocols and data
Our platform indexes, scans, and links to decentralised protocols, blockchains, and external third-party sites. We do not control, endorse, or assume responsibility for the underlying consensus protocols, smart contract execution, third-party software, or content found on linked external platforms.
6. Indemnification
You agree to indemnify, defend, and hold harmless Fraudalysis and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your access to or misuse of our API, platform, or analytical data.
7. Governing law and dispute resolution
These terms are governed by and construed in accordance with the laws of Queensland, Australia. Any dispute, controversy, or claim arising out of or relating to these terms shall first be addressed through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to mediation, and failing resolution, to the exclusive jurisdiction of the courts of Queensland, Australia.
8. Severability & modification
If any provision of these terms is deemed unlawful, void, or unenforceable, that provision shall be severed from the remaining terms, which remain in full force and effect. We may modify these terms at any time; the "Last updated" date above will reflect changes. Your continued use of the Platform after modifications constitutes acceptance of the new terms.
